More Deputy Attorney General, Less New York Attorney General

Bitcoin and cryptocurrency regulation have been hot topics in the legal and political spheres recently. Deputy Attorney General (DAG) Blanche made a bold move by publishing a memo titled “Ending Regulation By Prosecution,” in which he announced that the U.S. Department of Justice would no longer target virtual currency exchanges, mixing and tumbling services, and offline wallets for unwitting violations of regulations. This decision marks a significant shift in the DOJ’s approach to crypto enforcement.

On the flip side, New York Attorney General (NYAG) James took a different stance in a letter co-authored with congressional leaders. They called for federal crypto regulation to prevent the use of crypto mixers for illicit purposes. NYAG James specifically mentioned the need for cryptocurrency platforms to comply with anti-money laundering laws, know your customer (KYC) regulations, and cyber security protocols to prevent the financing of terrorism and crime.

While DAG Blanche’s memo showed a willingness to give users of Bitcoin and crypto mixers the benefit of the doubt, NY AG James seemed to imply that all users of such mixers are criminals. This kind of rhetoric is concerning as it presumes guilt without evidence. It’s important to recognize that some individuals, such as human rights activists, use mixers to protect their privacy and the privacy of their donors. Additionally, U.S. citizens have a right to financial privacy that should be respected.

As discussions around Bitcoin privacy continue to evolve, it’s crucial to amplify the fair and just rhetoric put forth by DAG Blanche while pushing back against the unjust assumptions made by NY AG James. The cases involving Samourai Wallet and Tornado Cash highlight the importance of protecting our right to transfer value across the internet privately.

In conclusion, the fight for financial privacy in the digital age is ongoing, and it’s essential for individuals to voice their opinions on this matter. Let your elected officials know that this issue matters to you, and stay informed as developments unfold in the world of cryptocurrency regulation.
